Terms of Service

1. Who we are

Foil is operated by Henry Kirkness, a sole trader trading as “Foil”, based in England, United Kingdom (“Foil”, “we”, “us”). You can reach us at henry@kirkness.com.

2. What these terms cover

These terms govern your use of the Foil service — the web application, the Foil app for Attio, and the APIs behind them (together, the “Service”). By creating an account or connecting an Attio workspace you agree to these terms on your own behalf and, if you use Foil for an organisation, on that organisation's behalf too.

3. The Service

Foil connects to your Attio workspace, reads content you authorise it to read (such as call recordings and transcripts, notes, emails and deal records), and uses AI to extract competitive signals and maintain battlecards about the competitors that appear in that content. Foil also writes some of its output back into your Attio workspace — for example Competitor records, list entries and battlecard notes.

4. Your account and workspace

  • You must provide a valid email address and keep access to it — sign-in codes are sent there.
  • You are responsible for activity that happens under your account.
  • Connecting an Attio workspace requires authorisation via Attio's OAuth flow. You confirm you are permitted to connect that workspace and to grant Foil the access scopes shown at connect time.
  • Multiple users may connect the same Attio workspace; they share that workspace's data, battlecards and subscription in Foil.

5. Your content and your responsibilities

The content Foil reads from your workspace stays yours. You grant us the limited rights needed to operate the Service: to store, process and analyse that content, and to display the results to you and your teammates. We do not use your content to train AI models, and we do not sell it.

You are responsible for the content in your workspace. In particular:

  • You must have the right to share that content with us — including any consents required to record and process the calls you feed in.
  • You must comply with the laws that apply to you, including call-recording and data-protection law in your jurisdiction.
  • You must not use the Service to process content you have no right to process, or for anything unlawful.

6. AI-generated output

Battlecards, signals and related insights are generated by AI from your workspace content. We work hard to make them accurate and every material claim links to its source, but AI output can be wrong, incomplete or out of date. The Service provides decision support, not advice — verify a claim against its cited source before you rely on it in a deal, contract or public statement.

7. Free trial

New workspaces get a 14-day free trial with full features and no payment details required. During the trial the initial backfill is capped (currently to the 200 most recent sources). When the trial ends, your battlecards remain readable but processing of new content pauses until you subscribe.

8. Subscriptions and billing

  • Paid plans are billed per workspace, monthly or annually, through our payment provider Stripe. Prices are shown at checkout.
  • Plans are metered on active deals — deals with activity Foil processed in the billing month. If usage exceeds your plan's included volume we will tell you in the app before anything is restricted; sustained overage may require an upgrade.
  • You can change or cancel your plan at any time from Settings. Cancellation takes effect at the end of the current billing period; we don't offer refunds for partial periods except where the law requires them.
  • If a payment fails we retry and keep the Service running for a grace period before pausing processing.
  • We may change prices with at least 30 days' notice; changes apply from your next billing period.

9. Acceptable use

  • Don't attempt to probe, breach or overload the Service, or access data belonging to another workspace.
  • Don't resell or white-label the Service without our written agreement.
  • Don't use the Service to violate anyone else's rights, including intellectual-property and privacy rights.

10. Intellectual property

We own the Service — the software, design and branding. You own your workspace content, and the battlecards generated from your content are yours to use within your organisation. Feedback you give us about the Service may be used freely to improve it.

11. Availability and changes

We aim to keep the Service reliable but it is provided “as is” and we don't guarantee uninterrupted availability. We may change or improve features over time; if we discontinue the Service or remove something material, we'll give you reasonable notice and a way to export or retain your battlecards where practicable.

12. Termination

You can stop using Foil at any time: disconnect the Attio integration and delete your account from Settings, which deletes your workspace's data from our systems (see the Privacy Policy for retention details). We may suspend or terminate accounts that breach these terms, create legal risk, or remain unpaid past the grace period — where reasonable, we'll warn you first.

13. Liability

Nothing in these terms limits liability that cannot be limited by law (including for fraud, or death or personal injury caused by negligence). Subject to that: we are not liable for indirect or consequential losses, loss of profits, or loss of data caused by events outside our reasonable control; and our total liability arising out of the Service in any 12-month period is capped at the amount you paid us for the Service in that period (or £100 if you haven't paid anything).

14. Changes to these terms

We may update these terms as the Service evolves. If a change is material we'll notify you by email or in the app at least 14 days before it takes effect. Continuing to use the Service after that date means you accept the updated terms.

15. Governing law

These terms are governed by the laws of England and Wales, and the courts of England and Wales have exclusive jurisdiction over disputes arising from them — except that if you are a consumer you keep any mandatory protections of the country you live in.
